1. Introduction

Welcome to MyHerro. These Terms and Conditions govern your use of the MyHerro platform (the "Platform"), operated by MyHerro Ltd ("we", "us", or "our"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

2. Definitions

  • "Platform" refers to the MyHerro website and any associated services.
  • "Customer" refers to any individual or business seeking vehicle transport or recovery services.
  • "Partner" refers to independent vehicle transport and recovery service providers registered on the Platform.
  • "Services" refers to vehicle transport, recovery, and related services arranged through the Platform.
  • "Booking" refers to a confirmed arrangement for Services between a Customer and Partner.

3. Platform Role

Important: MyHerro operates as an intermediary marketplace platform that connects Customers with independent recovery and transport Partners. We do not directly provide transport or recovery services. The service contract is between you (the Customer) and the Partner you book. MyHerro facilitates the connection, payment processing, and communication between parties but is not a party to the service contract itself.

4. Eligibility

To use the Platform, you must be at least 18 years old and have the legal capacity to enter into binding contracts. By using the Platform, you represent and warrant that you meet these eligibility requirements.

5. Account Registration

To access certain features of the Platform, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

6. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose
  • Provide false or misleading information
  • Interfere with or disrupt the Platform's operation
  • Attempt to gain unauthorised access to any part of the Platform
  • Use the Platform to harass, abuse, or harm others
  • Circumvent the Platform to arrange services directly with Partners

7. Service Availability

While we strive to connect Customers with available Partners, we do not guarantee that a Partner will be available for every request. Service availability depends on Partner capacity, location, and other factors beyond our control.

8. Payments and Deposits

When booking Services through the Platform:

  • A deposit may be required to confirm your booking
  • Deposits are processed securely through our payment provider (Stripe)
  • The remaining balance is payable directly to the Partner upon service completion
  • All prices displayed are in British Pounds (GBP) and include VAT where applicable

9. Refund Policy

Refunds of deposits are subject to our cancellation policy. If a Partner cancels a booking, you will receive a full refund of any deposit paid. Refund requests for other circumstances will be assessed on a case-by-case basis.

10. Cancellation

Cancellation terms vary based on timing:

  • More than 24 hours before scheduled service: Full deposit refund
  • Less than 24 hours before scheduled service: 50% deposit refund
  • Same day cancellation: No refund
  • Breakdown/emergency services: Non-refundable once Partner dispatched

11. Limitation of Liability

To the fullest extent permitted by law, MyHerro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or Services arranged through it. Our total liability shall not exceed the amount of fees paid to us for the specific booking in question.

12. Dispute Resolution

If you have a dispute with a Partner regarding Services, please contact us at support@myherro.com. We will endeavour to facilitate resolution but are not obligated to mediate disputes as the service contract is between you and the Partner.

13. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of MyHerro or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

14. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via the Platform or email. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
